1. Agreement to Terms

By downloading, installing, or using WhatIsIt (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and iPhone Tools ("we", "us", or "our").

2. Description of Service

WhatIsIt is an iOS application that provides AI-powered object identification and document translation. The App allows users to:

  • Take or import photos and receive AI-generated identification results
  • Ask follow-up questions about identified objects
  • Photograph documents or signs and receive translations in supported languages
  • Download and use an on-device AI model for offline identification
  • Browse a searchable history of past identifications

3. Account Registration

You may use the App as a guest without creating an account (limited to 5 identifications per day). To access higher daily limits and history, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. License and Restrictions

4.1 License Grant

Subject to these Terms and applicable App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

This App is intended for personal use only and is not licensed for commercial use. You may not use the App, its AI identification results, or its translation output as part of any commercial product, service, or business operation without prior written permission from iPhone Tools.

4.2 Restrictions

You agree NOT to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove any copyright, trademark, or other proprietary notices
  • Use the App for any illegal or unauthorized purpose
  • Submit photos of people without their consent for identification
  • Attempt to circumvent the daily usage limits or subscription system
  • Use automated tools to access or interact with the App
  • Resell, sublicense, or distribute the App to third parties

5. Subscription Terms

5.1 Free Tier

The App is available for free with the following daily limits:

  • Guest (no account): 5 identifications per day
  • Registered account (free): 10 identifications per day
  • Document translation is included at no cost

5.2 Paid Subscriptions

A subscription unlocks higher usage limits and premium AI models:

  • Monthly Subscription: Billed monthly
  • Yearly Subscription: Billed annually (~33% savings vs monthly)
  • Subscribers receive 100 identifications per day
  • Access to the Powerful Mode, Google Gemini AI, and offline on-device model

5.3 Payment and Billing

All purchases are processed through Apple's App Store:

  • Payment is charged to your iTunes Account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your App Store Account Settings

5.4 Cancellation

You may cancel your subscription at any time through your App Store Account Settings. Cancellation takes effect at the end of the current billing period. Access continues until the end of the paid period.

5.5 Free Trial

We may offer a free trial period for subscriptions. The trial period and any applicable terms will be stated at the time of subscription. After the trial ends, your subscription will automatically convert to the paid plan unless cancelled before the trial expires.

6. AI Results Disclaimer

AI-generated identification results, translations, and any follow-up answers are provided for informational purposes only. You acknowledge that:

  • AI results may be inaccurate, incomplete, or misleading
  • Results must not be relied upon for medical, safety, legal, nutritional, or critical decisions
  • The confidence score is an indicator of AI certainty, not a guarantee of accuracy
  • We continuously update AI models, which may affect result consistency over time
  • Translation accuracy depends on image quality and text complexity

Always consult a qualified professional for decisions that matter.

7. Acceptable Use

You agree to use the App only for lawful purposes. You must not use the App to:

  • Identify or track individuals without their consent
  • Process images containing illegal content
  • Infringe on the intellectual property rights of others
  • Engage in any activity that could harm minors
  • Attempt to harm, disrupt, or gain unauthorized access to our servers or systems

We reserve the right to terminate accounts that violate these guidelines.

8. Disclaimers and Limitations of Liability

8.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • AI identification or translation results will be accurate or complete
  • The App will be compatible with all devices or iOS versions
  • The App is free of viruses or harmful components

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IPHONE TOOLS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON AI-GENERATED RESULTS.

Our total liability to you for all claims related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Data and Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle data.

10. Intellectual Property

The App, including all content, features, functionality, source code, AI models, and user interface, is owned by iPhone Tools and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

WhatIsIt, iPhone Tools, and associated logos are trademarks of iPhone Tools. You may not use these marks without our prior written permission.

11. Apple App Store Terms

These Terms are between you and iPhone Tools, not Apple. Apple has no obligation to provide maintenance or support for the App. You agree that:

  • Apple is not responsible for the App or its content
  • Apple has no warranty obligations regarding the App
  • Apple is not responsible for addressing claims related to the App
  • Apple is a third-party beneficiary of these Terms and may enforce them

Your use of the App must comply with Apple's App Store Terms of Service.

12. Updates and Changes

12.1 App Updates

We may release updates, new features, or bug fixes at any time. Updates may change AI model behavior, daily limits, or available features. You are responsible for maintaining compatible iOS versions.

12.2 Terms Changes

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

13.1 Termination by You

You may terminate these Terms at any time by:

  • Deleting your account within the App
  • Canceling your subscription through the App Store
  • Deleting the App from your device

13.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in fraudulent, illegal, or abusive conduct.

13.3 Effect of Termination

Upon termination:

  • Your license to use the App terminates immediately
  • Your account and associated data will be deleted
  • No refunds will be provided for remaining subscription periods

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where iPhone Tools operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or the App shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in courts of competent jurisdiction.

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
