1. Agreement to Terms

By downloading, installing, or using FencingLab (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and iPhone Tools ("we", "us", or "our").

2. Description of Service

FencingLab is an iOS application that provides AI-powered fencing video analysis. The App allows users to:

  • Record or import fencing training and competition videos
  • Analyze videos using AI for technique scoring and coaching insights
  • Track progress and performance over time
  • Build fencer profiles and view matchup analysis
  • Share videos with teammates, coaches, and the community

3. Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. License and Restrictions

4.1 License Grant

Subject to these Terms and applicable App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove any copyright, trademark, or other proprietary notices
  • Use the App for any illegal or unauthorized purpose
  • Upload content that violates the rights of others
  • Attempt to circumvent the credit or subscription system
  • Use automated tools to access or interact with the App
  • Resell, sublicense, or distribute the App to third parties

5. Subscription and Credit Terms

5.1 Trial Period

The App offers a 7-day free trial period from account creation:

  • Includes 5 free analysis credits
  • Access to all features during the trial
  • No payment required during the trial period
  • The trial is available once per account

5.2 Paid Subscriptions

After the trial period, continued use requires a paid subscription:

  • Monthly Subscription: Billed monthly
  • Yearly Subscription: Billed annually (~33% savings)

5.3 Analysis Credits

AI video analysis requires credits in addition to a subscription:

  • Credits are purchased in packs (1, 5, 10, or 20 credits)
  • Immediate analysis uses standard credit cost
  • Batch analysis uses 50% fewer credits
  • Credits do not expire while your account is active

5.4 Payment and Billing

All purchases are processed through Apple's App Store:

  • Payment is charged to your iTunes Account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your App Store Account Settings

5.5 Cancellation

You may cancel your subscription at any time through your App Store Account Settings. Cancellation takes effect at the end of the current billing period. Unused credits remain available until your account is deleted.

6. User Content

6.1 Your Videos

You retain ownership of all videos you upload to FencingLab. By uploading videos, you grant us a limited license to process, store, and display them in accordance with your privacy settings.

6.2 Content Guidelines

You agree that uploaded content must not:

  • Contain illegal, harmful, or offensive material
  • Violate the privacy or rights of others
  • Contain content unrelated to fencing
  • Include malware or harmful code

We reserve the right to remove content that violates these guidelines.

6.3 Shared and Public Videos

When you share videos or make them public, other users can view them. You are responsible for ensuring you have the right to share videos featuring other people.

7. AI Analysis Disclaimer

AI-generated analysis, scores, and recommendations are provided for informational and training purposes only. You acknowledge that:

  • AI analysis may not be 100% accurate
  • Scores and recommendations should not replace professional coaching
  • Analysis quality depends on video quality, angle, and lighting conditions
  • We continuously improve our AI models, which may affect scoring consistency

8. Disclaimers and Limitations of Liability

8.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • AI analysis results will be accurate or complete
  • Defects will be corrected
  • The App is free of viruses or harmful components

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IPHONE TOOLS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Our total liability to you for all claims related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Data and Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle data.

10. Intellectual Property

The App, including all content, features, functionality, source code, AI models, and user interface, is owned by iPhone Tools and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

FencingLab, iPhone Tools, and associated logos are trademarks of iPhone Tools. You may not use these marks without our prior written permission.

11. Apple App Store Terms

These Terms are between you and iPhone Tools, not Apple. Apple has no obligation to provide maintenance or support for the App. You agree that:

  • Apple is not responsible for the App or its content
  • Apple has no warranty obligations regarding the App
  • Apple is not responsible for addressing claims related to the App
  • Apple is a third-party beneficiary of these Terms and may enforce them

Your use of the App must comply with Apple's App Store Terms of Service.

12. Updates and Changes

12.1 App Updates

We may release updates, new features, or bug fixes at any time. Updates may be required for continued use of the App. You are responsible for maintaining compatible iOS versions.

12.2 Terms Changes

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

13.1 Termination by You

You may terminate these Terms at any time by:

  • Deleting your account within the App
  • Canceling your subscription through the App Store
  • Deleting the App from your device

13.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in fraudulent, illegal, or abusive conduct.

13.3 Effect of Termination

Upon termination:

  • Your license to use the App terminates immediately
  • Your account and associated data will be deleted
  • Unused credits are forfeited
  • No refunds will be provided for remaining subscription periods or unused credits

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where iPhone Tools operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or the App shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in courts of competent jurisdiction.

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
